Terms of Service

1. Overview

Magic Narrator is a text-to-audio narration platform that creates multi-narrated audio stories from user-provided text. You retain ownership of your content, subject to the licenses granted herein, and are responsible for ensuring you have the necessary rights to the text you upload or input.

2. Accounts

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

3. Subscriptions, Payments, and Refunds

• Subscriptions are billed in advance on a recurring basis (e.g., monthly or annually) and continue until canceled. You can manage or cancel your subscription at any time in your account settings.
• Fees are exclusive of taxes. You authorize us and our payment processor (e.g., Stripe) to charge your payment method for applicable fees.
• Except where required by law, all payments are non-refundable. We may, at our discretion, offer prorated credits in the event of Service errors or outages.

4. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal or business purposes in accordance with these Terms.

5. Your Content

• You retain all rights to the text and other content you submit to the Service ("User Content").
• You represent and warrant that you own or have the necessary rights to submit User Content and to grant the licenses described below, and that your User Content does not violate applicable law or the rights of any third party.
• You grant Magic Narrator a worldwide, non-exclusive, royalty-free license to host, process, transcribe, synthesize, and otherwise use your User Content solely to provide and improve the Service (including quality assurance, troubleshooting, safety, and analytics). We do not claim ownership of your User Content.

6. Generated Audio and Voices

• The Service may use third-party text-to-speech (TTS) engines and voice models. You are responsible for ensuring that your use of generated audio complies with applicable laws, including publicity, voice cloning, and content laws.
• Unless otherwise stated, we grant you a non-exclusive license to download and use the audio generated from your User Content for your lawful purposes, subject to these Terms, your subscription plan, and any third‑party license restrictions.

7. Acceptable Use Policy

You agree not to misuse the Service. Prohibited conduct includes, without limitation:

• Uploading or generating content that is illegal, infringing, harassing, or hateful.
• Attempting to impersonate others or misappropriate voices without authorization.
• Reverse engineering, scraping, or abusing API limits or platform security.
• Interfering with or disrupting the Service or its infrastructure.
• Using the Service to violate third-party terms or applicable law.

8. Copyright / IP Policy and DMCA

• We respect intellectual property rights and expect our users to do the same. It is your responsibility to ensure you have the necessary rights to any text or materials you submit.
• If you believe that content in the Service infringes your copyrights, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent atsupport@magicnarrator.com with: (a) identification of the work and allegedly infringing material; (b) your contact information; (c) a statement of good-faith belief; (d) a statement under penalty of perjury that you are authorized to act; and (e) your physical or electronic signature.

9. Third-Party Services

The Service may integrate third-party services (e.g., payment processors, analytics, and TTS providers). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party services.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, including the Acceptable Use Policy. Upon termination, your right to access the Service will cease, but certain provisions will survive (e.g., intellectual property, disclaimers, limitations of liability, and indemnities).

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE AUDIO OUTPUT WILL BE ERROR-FREE, SUITABLE FOR EVERY USE CASE, OR FREE FROM INTERRUPTIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIC NARRATOR AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

13. Indemnity

You agree to indemnify and hold harmless Magic Narrator and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms.

14. Changes to the Service or Terms

We may modify the Service and these Terms from time to time. If we make material changes, we will notify you (for example, by email or a notice in the app). Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
